Standard Study Contract Conditions of Multilingua Keelekeskus OÜ

These Standard Conditions are approved by the board of Multilingua Keelekeskus OÜ on 1 December 2011.
Multilingua Keelekeskus (hereinafter Multilingua Language Center) is a language school based on Austrian and Finnish private
capital, established in 1994.
These Standard Conditions are intended to be used in connection with other contractual parties. The Standard Conditions form
a part of the Study Contract; another party to the Contract may access the text of these Conditions on the website on Multilingua
Language Center.
Where the Standard Conditions contradict any provisions separately agreed by the Parties, the separately agreed provisions
shall apply.
The Standard Conditions shall be interpreted as they would be understood by a reasonable person similar to a contractual party
in similar circumstances.
1. GENERAL PROVISIONS
1.1. While performing the Standard Conditions the Parties shall be guided by legal acts in force in the Republic of Estonia and
by the Study Contract.
1.2. The Standard Conditions include the list of all expenses to be borne by the Student.
1.3. The Standard Conditions and the Study Contract shall form a single integral agreement between the Parties.
2. GENERAL STUDY PRINCIPLES
2.1. Study courses of Multilingua Language Center are conducted according to the respective study license no. HTM 7038
issued by the Ministry of Education and Research of the Republic of Estonia and approved study programs.
2.2. Foreign language study is based on communicative teaching methods and the Common European Framework of
Reference for Languages: Learning, Teaching, Assessment.
2.3. Foreign language instructors employed by Multilingua Language Center possess respective higher education and
experience in the field of adult training.
2.4. The study period for language courses is based on the study plan schedule approved by Multilingua Language Center.
2.5. The number of study hours (academic hours) for language courses is preliminary set by Multilingua Language Center.
2.6. Multilingua Language Center provides for study of Estonian, Chinese, Spanish, Dutch, English, Italian, Greek, Norwegian,
Portuguese, French, German, Finnish, Danish and Russian languages.
2.7. Multilingua Language Center allows studying different combinations of languages or going abroad in order to study
languages.
3. FORMS OF STUDY
3.1. Multilingua Language Center provides for the following forms of language study:
3.1.1. Group studies – language study takes place in groups of 6-8 people of similar language proficiency level.
3.1.2. Minigroup studies – language study takes place in groups of 3-5 people of similar language proficiency level.
3.1.3. Individual tutoring – language study for 1 or 2 persons. Study plans, schedule and place of study are to be separately
agreed by the instructor and the student(s).
3.1.4. Multi-skype studies – an individual tuition form, where lessons are conducted using the Internet telephony services. Study
plans and schedule are to be separately agreed by the instructor and the student.
3.1.5. Multi-More studies – a study form that consists of two parts: group studies according to the study plan and individual study
in the Internet language learning environment Tell Me More. 3.1.6. Distant learning – student studies a foreign language independently in the Internet language learning environment Tell Me
More.
3.1.7. In-house training for businesses – language study courses ordered by an employer.
3.2. The particular form of study is indicated in the Study Contract.
4. PLACE OF STUDY
4.1. The place of language study is Multilingua Language Center premises located at Pärnu mnt. 16, Tallinn (where the Parties
do not agree differently). In-house training for businesses may take place both on Multilingua premises or on the customer’s
premises. Where language study takes place on the customer’s premises, the customer shall provide for a suitable study room.
Where language study does not take place on Multilingua premises, all participants are informed about the place of study.
5. RIGHTS AND OBLIGATIONS OF THE PARTIES
5.1. Multilingua Language Center shall:
5.1.1. Assemble language study groups according to the language proficiency level of the students involved.
5.1.2. Conduct language courses according to the study program of the course.
5.1.3. Keep record of conducted lessons.
5.1.4. Conduct lessons that were cancelled due to instructor’s illness or any other reason according to separate agreement with
students at the time that is suitable for them.
5.1.5. By the end of study courses issue certificates to the students who participated at least in 50% of all the lessons of a
particular course and passed the final course test.
5.1.6. Multilingua Language Center has the right not to refund the payment made where the Student drops a study course.
5.1.7. Multilingua Language Center has the right not to open a study group where the number of people registered for the
course in less than was originally planned.
5.1.8. Multilingua Language Center has the right to change the number of lessons and their price where the number of people
registered for the course is less than was originally planned, having informed members of the group about respective changes.
5.1.9. Multilingua Language Center does not offset the price of lessons skipped by the Student.
5.2. The Student shall:
5.2.1. Participate in courses for which the Student is registered or with regard to which the Student has confirmed his/her
participation in a form that can be reproduced in print.
5.2.2. Pay the price of language courses in due time on the basis of invoice issued by Multilingua Language Center.
5.2.3. The Student has the right to pay for courses in installments (the maximum of three installments is allowed) on the basis of
the payment schedule approved by Multilingua Language Center.
5.2.4. The Student has the right to receive from Multilingua Language Center a certificate confirming his/her participation in
particular course, where he/she participated at least in 50% of all the lessons of a particular course and passed the final course
test.
5.2.5. The Student has the right to abandon a language course no later than after the second lesson. Where the Student choses
to abandon the course at a later time, he/she is still obliged to pay the course fee.
5.2.6. The Student has the right to receive a 5% loyal customer’s discount from a course’s full price, where he/she has
participated in any language courses organized by Multilingua Language Center within the last 5 years.
5.2.7. The Student shall inform Multilingua Language Center about his/her inability to attend individual lessons no later than in
24 hours before the lesson starts. Where the Student fails to comply with this obligation he/she shall be obliged to pay for the
individual lessons in full.
5.2.8. The Student who has paid for courses as a private individual has the right to apply for an income tax refund of 20% of the price of studies in the income tax return filed to the Tax and Customs Board.
6. THE PRICE AND THE PAYMENT CONDITIONS
6.1 The pricelist of Multilingua Language Center.
6.2. The price of particular course is indicated in the Study Contract and it may differ from that provided in the pricelist.
6.3. The Student shall pay for language courses according to the invoice issued by Multilingua Language Center by the due
date indicated on the invoice, or, where the Student so desires with a card or in cash in the offices of Multilingua Language
Center.
6.4. While registering for Multilingua Language Center courses the Student shall not make any advance payments. The invoice
for payment for particular course is issued to the Student after the end of the first lesson of such course.
6.5. Access to the Internet language learning environment Tell Me More is granted to the Student who has selected Multi More
or distant learning as his/her form of study after payment of respective invoice. User license for the website is valid for 6 months
after its opening and after payment of the invoice and forwarding the necessary passwords to the Student it is no longer
possible to close the license or refund the payment.
6.6. Where the study aid for a course is an original textbook, its price is added to the price of the course.
6.7. In case of breach of payment deadlines Multilingua Language Center has the right to demand the fine of 0.5% of the unpaid
amount for each day of delay.
6.8. Where the Student does not participate in the scheduled lessons, he/she has no right to demand refund of the payment
made.
6.9. Where the Student has made an advance payment but abandons studies before the end of the course, the question of
refund of the payment made is decided by the board of Multilingua Language Center, and a respective application can only be
satisfied where studies where abandoned for good and valid reason.
7. OTHER PROVISIONS
7.1. All Study Contracts shall be treated as confidential.
7.2. Any claims in connection with performance of the Study Contract shall be presented to Multilingua Language Center without
delay, but not later than within one month after the circumstances being the grounds for the claim were discovered.
7.3. Multilingua Language Center shall review a claim within 10 working days after receiving it.
7.4. The Study Contract shall come into force after it is signed and shall remain in force until the performance of contractual
obligations or until the Contract is terminated by any Party.
7.5. Multilingua Language Center has the right to terminate the Study Contract early, where the Student has delayed
performance of his/her payment obligations for longer than 7 banking days (from the due date indicated on particular invoice) or
where the study schedule was breached due to the Student’s fault for three consecutive times and the Student has failed to
inform about it at least in 24 hours in advance.
7.6. The Student has the right to terminate the Study Contract early, where the study schedule was breached due to the fault of
Multilingua Language Center for three consecutive times and Multilingua Language Center has failed to inform about it at least
in 24 hours in advance.
