Standard Terms and Conditions of the training agreement Multilingua Keelekeskus OÜ

These Standard Terms and Conditions were approved by the Management Board of Multilingua Keelekeskus OÜ on September 5th, 2023. 
Multilingua is a language school established in 1994. Its main field of work is teaching foreign languages to kids, teens and adults.
These Standard Terms and Conditions have been previously developed for use in relation to the other party.
The Standard Terms and Conditions are part of the Learning Agreement, and the other party has the opportunity to know their content on the Internet site of the Multilingua Language Center.
If a standard term is in contradiction with the condition specifically agreed upon by the contracting parties, the condition specifically agreed upon applies.
A standard clause must be interpreted in the same way as a reasonable person similar to the other contracting party should understand under the same circumstances.

  1. GENERAL PROVISIONS
    1. In fulfilling the Standard Terms and Conditions, the parties are guided by the legislation in force in the Republic of Estonia and the Training Agreement.
    1.2. The Standard Terms and Conditions include a list of all expenses incurred by the Trainee.
    1.3. Standard Terms and Conditions and Training Agreement constitute a single and indivisible agreement between the Parties.
  2. GENERAL PRINCIPLES FOR TRAINING
    In its activities, the Multilingua Language Center is based on the Estonian Adult Education Act and the Adult Education Standard.
    2.1. Foreign language learning is based on the communicative teaching method and the framework document for European language learning: learning, teaching, and assessment.
    2.2. The foreign language teachers working in the Multilingua Language Center have professional higher education and adult, teen and children education experience.
    2.3. The language course period lasts according to the timetable and schedule approved by the Multilingua Language Center.
    2.4. The volume of the hours of the language course (academic hours) is pre-determined by the Multilingua Language Center.
    2.5. At Multilingua Language Center you can learn Arabic, Estonian, Chinese, Spanish, Dutch, English, Italian, Japanese, Greek, Latvian, Norwegian, Portuguese, French, Polish, Swedish, German, Finnish, Danish, Turkish and Russian.
    2.6. At Multilingua Language Center, you can take language consultations, language learning consulting or go to language courses abroad through the Multilingua Language Center.
  3. TRAINING FORMS
    In the Multilingua Language Center, you can learn foreign languages ​​in the following forms:
    3.1. Group learning – a form of learning where language learning takes place in a group of 6-8 people whose language level is similar.
    3.2. Minor group learning – a form of learning where language learning takes place in a group of 3 to 5 learners with a similar language level.
    3.3. Individual learning – a form of learning where 1 to 2 learners at the time participate in the language learning. Curriculum, class schedule and the venue of classes according to a common agreement between the teacher and the learner(s).
    3.4. Language learning can be conducted as contact or distance learning. Contact learning is a form of learning where during classes the teacher and the learners are physically present in the same room. Distance learning is a form of learning where classes take place in a virtual space.
    3.5. Language learning can be conducted in a form of flexible learning, where simultaneously a part of learners participates in learning in a virtual space, and a part in a physical room.
    3.6. A specific form of training is indicated in the Learning Agreement.
  4. TRAINING VENUE
    4.1. The language learning venue is Multilingua Language Center at Roosikrantsi 11, Tallinn unless agreed otherwise. In-house training can take place both at Multilingua and on the premises of the customer. If courses take place outside the premises of the Multilingua Language Center, all course participants will be notified of the location of the study room.
  5. RIGHTS AND OBLIGATIONS OF THE PARTIES
    5.1. Multilingua Language Center undertakes
    5.1.1. To fill the language classes according to the language level of the learners.
    5.1.2. To conducts a language course in accordance with the curriculum of the course.
    5.1.3. To keep records of occurrence of classes.
    5.1.4. The classes that did not take place due to the illness of the teacher or some other reason should be carried out in agreement with the learners on an advance agreement with them and at the time suitable for them.
    5.1.5. To issue a certificate at the end of the course for those students who have attended at least 50% of the classes of the course and have acquired the specified learning output.
    5.1.6. To issue a certificate at the end of the course for those students who have attended less than 50% of the classes of the course and have not acquired the specified learning output.
    5.1.7. The Multilingua Language Center has the right not to refund a fee for students who dropped out of the course.
    5.1.8. The Multilingua Language Center has the right to not open the course group if fewer people have registered than the size of the proposed group size.
    5.1.9. The Multilingua Language Center has the right to change the volume and price of the course if fewer persons have registered for the study group, informing the group members about changes.
    5.1.10. Multilingua Language Center does not offset the cost of lessons not attended by the learner.
    5.2. The learner undertakes:
    5.2.1. To participate in the course for which he/she has registered or confirmed their participation in a form that can be reproduced in writing.
    5.2.2. To pay the cost of the language course on time based on the invoice issued by the Multilingua Language Center.
    5.2.3. The learner has the right to pay for language courses in parts, up to a maximum of three parts based on a specific payment schedule established by the Multilingua Language Center.
    5.2.4. The learner is entitled to receive the certifying completion of language courses from the Multilingua Language Center certificate if he or she has attended at least 70% of the classes and acquired the learning output stipulated in the curriculum.
    5.2.5. The learner has the right to drop the language course at the latest after the second class; the later drop out does not release the learner from paying for the course.
    5.2.6. The parent or the guardian has the right to give up the child’s place at kids’ language club if the wish to do so has been forwarded in a written form to Multilingua’s course coordinator 20 days beforehand. 5.2.7. The learner has the right for 5% discount for regular customer benefits if he or she has previously participated in a language course of the Multilingua Language Center over the last 5 years.
    5.2.8. The learner has the right for 15% discount if he or she continues with next module or next level course.
    5.2.9.The loyal customer discount does not apply if the course has an early registration discount price.
    5.2.10. The learner is required to inform the Multilingua Language Center of his or her absence from an individual training class at least 24 hours in advance. In the event of failure to comply with the obligation to notify, the learner is required to pay the full price for the classes that did not take place.
    5.2.11. The learner has the right, when paying for the training as a private person, to apply for return of 20% of the training costs from the Tax and Customs Board when submitting the income tax return.
  6. PRICE AND PAYMENT TERMS
    6.1. The price of the training is indicated in the Training Agreement.
    6.2. The learner will pay for courses according to the invoice issued by the Multilingua Language Center and according to the payment deadline indicated in the invoice or, if desired, at the Multilingua Language Center office in the form of a card payment or in cash.
    6.3. The learner does not need to pay a prepayment when registering at the courses of the Multilingua Language Center.
    6.4. The invoice for the course fee is submitted to the student after the first class.
    6.5. The price of the training includes the price of the study materials.
    6.6. The Multilingua Language Center may charge a penalty of up to 0.5% of the outstanding amount per day for violation of payment deadlines.
    6.7. If the trainee does not attend the classes scheduled in the training schedule, he or she will not be entitled to refund.
    6.8. If the Trainee has made a prepayment but discontinues his or her studies before the end of the course, the issue of the refund will be decided by the Management Board of the Multilingua Language Center, and the corresponding application may only be satisfied if there were valid and valid reasons for discontinuing the studies.
  7. OTHER TERMS AND CONDITIONS
    7.1. All training agreements are confidential.
    7.2. Complaints regarding the execution of the Training Agreement must be submitted to the Multilingua Language Center promptly, but not later than within one month after the circumstances giving rise to the complaint.
    7.3. Multilingua Language Center will review the complaint no later than 10 working days after it was received.
    7.4. The training agreement enters into force at the time of signing and is valid until the performance of the contractual obligations or cancellation of the agreement by a Party.
    7.5. The Multilingua Language Center may exceptionally cancel the Training Agreement if the Trainee has delayed fulfillment of the payment terms from the due date indicated on the invoice for more than 7 banking days or if by the fault of the Trainee, the training schedule has been violated for three consecutive times, and this has not been warned of for at least 24 hours in advance.
    7.6. The Trainee may exceptionally cancel the Training Agreement if by the fault of the Multilingua Training Center, the training schedule has been violated for three consecutive times and this has not been warned of for at least 24 hours in advance.
